Terms of Service
Terms governing access to and use of ServiceTechIQ.
Effective date: September 2, 2026
These Terms of Service ("Terms") govern access to and use of ServiceTechIQ. By creating an account, accepting an invitation, accessing a customer portal, or using the Services, you agree to these Terms. If you use the Services for an organization, you represent that you are authorized to bind or act for that organization as applicable.
1. Eligibility and Accounts
The Services are intended for lawful business use in the United States. Users must be at least 18 years old or the age of legal majority. You must provide accurate information, safeguard credentials, use multi-factor authentication when offered, and promptly report unauthorized access.
2. Customer Administration
The subscribing company controls its users, roles, customers, sites, work orders, records, and settings. Company administrators are responsible for granting and removing access, reviewing permissions, deactivating departed users, and ensuring that use complies with internal policies and law.
3. Permitted Use
You may use the Services only for authorized business purposes and in accordance with these Terms, the applicable subscription agreement, order form, documentation, and law. You may not interfere with security, probe or circumvent access controls, scrape the Services, introduce malicious code, misrepresent identity, access another customer's data, reverse engineer except where law prohibits restriction, or use the Services to violate another person's rights.
4. Customer Data
As between the parties, the customer retains its rights in data submitted to the Services. The customer grants Primal Array a limited right to host, process, transmit, display, back up, and otherwise use customer data to provide, secure, support, and improve the Services and fulfill legal obligations.
5. Field-Service and Life-Safety Disclaimer
ServiceTechIQ is a workflow, recordkeeping, and communication platform. It is not a fire-alarm monitoring station, emergency dispatch service, code authority, inspection certification service, engineering service, or substitute for trained personnel, manufacturer instructions, applicable codes, required testing, permits, or emergency procedures. Users remain responsible for field safety, code compliance, inspection accuracy, and professional judgment. Never rely on the Services as the sole means of detecting or responding to an emergency.
6. Timekeeping, Payroll, and Accounting
ServiceTechIQ may record time, leave, corrections, approvals, per diem, and related information and may transmit or export records to third-party systems. Primal Array is not an employer, payroll processor, accountant, tax adviser, or recordkeeping fiduciary. Customers must review and approve records and verify third-party submissions before payroll or accounting use.
7. Inventory, Equipment, Quotes, and Invoices
Inventory quantities, equipment records, pricing, estimates, quotes, invoices, and related records depend on customer and user input. Customers must verify counts, availability, tax treatment, pricing, scope, approvals, and final documents.
8. Integrations
Third-party integrations are subject to provider availability, authorization, terms, APIs, rate limits, approvals, and change. Primal Array does not control third-party services and is not responsible for their outages, errors, data handling, or discontinued functionality.
9. AI-Assisted Content
AI-assisted content may be incomplete, inaccurate, or unsuitable. Users must review and validate it. It must not be treated as legal, safety, code, engineering, financial, payroll, or other professional advice.
10. Intellectual Property
The Services, software, design, documentation, trademarks, and related technology are owned by Primal Array or its licensors. Except for the limited right to use the Services during an authorized subscription, no rights are granted.
11. Availability and Changes
We may maintain, update, modify, or discontinue features. We aim to provide reliable service but do not guarantee uninterrupted or error-free operation. Preview, beta, and experimental features may change or be withdrawn.
12. Suspension and Termination
We may suspend or restrict access for security threats, unlawful use, material breach, nonpayment, harm to the Services or others, or as required by law.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." Any paid-customer warranties and remedies are governed by the applicable Master Subscription Agreement.
14. Limitation of Liability
To the maximum extent permitted by law, Primal Array will not be liable under these Terms for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, or business opportunity. Liability to a paid customer is governed by its Master Subscription Agreement. For a user without a separate paid agreement, Primal Array's aggregate liability will not exceed one hundred U.S. dollars ($100), subject to applicable law.
15. Governing Law and Disputes
Arkansas law governs these Terms without regard to conflict-of-law principles. Subject to any different written agreement, state and federal courts located in or serving Garland County, Arkansas will have exclusive jurisdiction.
